Text Messaging Terms of Use

G2G Ventures, PBC dba Counter Beauty (“Counter Beauty” and collectively "us", "we" or "our") offers recurring text messaging programs and occasional one-time or limited-duration text messaging programs (“Messaging Service”), which may include marketing programs. These Text Messaging Terms and Conditions (“Text Terms”) govern these text message programs, unless a specific set of additional terms is provided.

By opting in, you agree to receive automated promotional and informational text messages on an ongoing basis (e.g., SMS, RCS and MMS) from Counter Beauty. Text messages may be sent by an automated messaging system or artificial or pre-recorded voice to the mobile telephone number you provided to us upon signing up for this service or any other number that you may input. Your carrier’s messaging & data rates apply. Your consent to receive automated text messages is not a condition of any purchase you make.

Messaging frequency may be subject to change. We reserve the right to change the volume of messages sent at any time and for any reason. We have the right to modify the short code or phone number from which this service sends you messages.

Due to the wide variety of mobile devices and handsets, you acknowledge that not all devices and/or interfaces may be supported by this service, and our messages may not be deliverable to you in all locations. Counter Beauty, its service providers, and the mobile carriers supported by the program are not liable for delayed or undelivered messages. Counter Beauty is not liable for delayed or undelivered messages.

Our Privacy Policy sets forth how we use the information we collect from you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number and/or email address you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages. We may also collect information about you using cookies or similar technologies. We may use this information to send you shopping cart reminders, special offers, alerts, updates, and other transactional and/or marketing texts and information.

By agreeing to these Text Terms, you also agree to the Company’s Terms of Use and Privacy Policy, which are hereby incorporated by reference. In the event of any conflict, these Text Terms shall control with regard to your use of this Messaging Service. In addition, as set forth in our Terms of Use, any dispute, controversy, or claim between the parties arising out of or relating in any way to these Text Terms will be resolved by binding individual arbitration conducted by JAMS (“JAMS”) under its rules.

Opt-In, Age Restriction, and Eligibility

To opt-in to receive text messages from a Counter Beauty text messaging program, please follow the instructions provided by Counter Beauty at the mobile phone number you provided when signing up or any other number you designate, which may include texting a message to a telephone number or short code, providing your phone number online at our website, or by otherwise providing your consent. You may need to confirm your consent, such as by replying “Y” or through another designated response to an initial text message sent to you.

In order to use this messaging service, you must be (a) 18 years or older, and (b) have the power to enter into a binding contract with us and not be barred from doing so under any applicable laws.

Choosing to Opt-Out

You may text the keyword “STOP” to opt out of this messaging service at any time. After texting “STOP,” you will receive confirmation from us that your opt-out request has been processed via a text message sent to you. Notwithstanding the foregoing, if you opt out of this text message program, you may continue to receive text messages from the Company through any other programs you have joined until you separately opt out from those programs.

For additional help or to request more information, reply “HELP” to the number from which you received our text messages.

Termination of Text Messaging

The Company may suspend or terminate this service and your receipt of the Company-related text messages if it believes you are in breach of these Text Terms or the Counter Terms of Use. Your use of this service and receipt of Counter text messages are also subject to termination in the event you no longer have access to your mobile telephone service. The Company reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Company text messaging service, with or without notice.

Mobile Phone Number Change

In the event that you change or deactivate your mobile phone number, you agree to notify the Company at http://counter.com/pages/contact. You understand and agree that your agreement to do so is a material part of these Text Terms. You further agree that, if you discontinue the use of your mobile telephone number without notifying Counter Beauty of such change, you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Counter Beauty or any party that assists in the delivery of mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of Counter Beauty’s text message programs.

We reserve the right to terminate or change our messaging program at any time. We also reserve the right to change these Messaging Terms at any time, and such changes will be effective immediately upon posting. You agree to review these Text Terms periodically to ensure that you are aware of any changes. Your continued enrollment and consent following such changes shall constitute your acceptance of such changes.
